DMCA Notice and Procedure for Copyright Infringement Claims

Broadcast Matrix LLC respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). We are committed to responding to notices of alleged copyright infringement and will take appropriate action under the DMCA and other applicable intellectual property laws.

Filing a DMCA Takedown Notice

If you believe that content hosted on our service infringes your copyright, you may submit a DMCA takedown notice by providing our DMCA Agent with the following information in writing (see 17 U.S.C § 512(c)(3)):

Required Information:

  • An electronic or physical signature of the person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work claimed to have been infringed, including the URL or other specific location where the original copyrighted work exists, or a copy of the copyrighted work
  • Identification of the URL or other specific location on our service where the allegedly infringing material is located
  • Your name, address, telephone number, and email address
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf

How to Submit:

Counter-Notification Procedure

If you believe that content was removed or access was disabled as a result of a mistake or misidentification, you may file a DMCA counter-notification with our DMCA Agent.

Required Information for Counter-Notification:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Western District of Washington if your address is outside the United States)
  • A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

Counter-Notification Process:

Email your complete counter-notification to: dmca@broadcastmatrix.com with “DMCA Counter-Notification” in the subject line.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original takedown notice. If we do not receive notice within 10-14 business days that the original complainant has filed a court action to restrain the allegedly infringing activity, we may restore or cease disabling access to the material.

Repeat Infringer Policy

Broadcast Matrix LLC maintains a policy of terminating user accounts that are determined to be repeat copyright infringers. Users who receive multiple valid DMCA takedown notices may have their accounts terminated without prior notice. This policy is designed to deter repeat infringement and is applied at our sole discretion.

We reserve the right to terminate services for users who commit repeat violations of copyright laws and will cooperate fully with any civil or criminal litigation arising from such violations.

Response to DMCA Notices

Upon receipt of a proper DMCA takedown notice, Broadcast Matrix LLC will:

  • Remove or disable access to the allegedly infringing material expeditiously
  • Notify the user who posted the material that it has been removed or access has been disabled
  • Provide the user with information about the DMCA counter-notification process
  • Maintain records of DMCA notices and actions taken

False Claims and Penalties

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney’s fees. Additionally, making false statements in a DMCA notice or counter-notification may constitute perjury under federal law.

We reserve the right to seek damages from any party that submits a false or fraudulent DMCA notice or counter-notification.

Processing Time

We process DMCA notices and counter-notifications as quickly as possible, typically within 24-48 hours of receipt. However, processing times may vary depending on the complexity of the request and our current workload.
